If anyone thinks that DCM Services is "trying to help the family" they are so sadly wrong. I am beginning to think that they are nothing more than "sharks". I have had it up to my ears with them. They are threatening, intimitating and down right obnoxious people. Yes I am Executor, but there are no assets, and the know this. But they want me to do the "right think" meet my obligations, hey this was my Moms debt (and her only one) not mine.

Sears cancelled what she owed, which Discover should have too. I have paid them $128.00 for three months out of fear, what can they do to me? I am on a fixed income, in other words I live pay check to paycheck.

I just need someone to advise me!!! Now I get something saying they have not heard from the estate, what is going on?

Heather,
We are sorry for your loss.

Thanks for your comment.

Read the article again regarding the deceased accounts. Very first paragraph.

“Some junk debt buyers specialize in deceased credit card accounts. Deceased meaning that the account holder has died. The account is charged off, written off and sold to a junk debt buyer. The collection agencies that are infamous for their debt recovery from the “alleged” accounts are Weltman, Weinberg & Reis, DCM Services, and Phillips & Cohen. The surviving family members are NOT responsible for paying the account of a deceased person. And not to mention, the debt collector usually cannot validate the “alleged” debt anyway. BUT with the deceased, debt collectors cannot collect.”

You still need to write a letter to DCM and get them to stop contacting you. The CA cannot collect from the deceased. The account is dead.

If you would like more advice regarding DCM and a letter to write, we suggest a 15 min free analysis with us. We can answer all your questions.

Boyfriend's mother died a year ago with considerable debt (at the moment, looks like about $130,000 from accounts as old as 15 years and as recent as, well... now). She owned her home, a crappy car, and a few thousand dollars worth of possessions. Boyfriend is her administrator (no will). We set up an estate account and posted a notice to creditors. We've received only two claims, one from DCM for some $12,000 for a really old account. Other debts have pretty much all been in collections for a long time (turns out she was hiding her mail for years).

We called DCM to ask for proof of ownership of the debt and an itemized bill. After all, we're not planning to pay late charges and will try to negotiate with them. They said they'd send one and were pretty pleasant, but did get pushy when he said that almost all of the estate is tied up in the home and that the house is not ready to be put on the market yet (it's a wreck.) I guess I'm just wondering, with all the conflicting info out there, which of these debts is the estate responsible for? Since there is an estate, is the answer just "all of them"? Or is it different when an account has already been sold to collections, charged off, what have you?

What a mess. We're in over our heads and can barely even sift through the mail. Thanks for all the great info.

Rita,
Thanks for your comment. Are you a consumer or a collection agency?

Debts die with the estate. The deceased does not need a FICO score any longer. The family is NOT RESPONSIBLE for paying the ccd or the collections.

If you have further information, please contact us directly. We welcome knowledge.

Debts do NOT die with the deceased. The estate is fully responsible for the debts. If there is no estate then the family can choose to clear up the debts or simply say there is no way to do so. If there is an estate, then a claim is filed. Simple as that.

SG,
Thanks for your comment. We are sorry about your loss.

We assume the credit cards are in the collection stage. No do not bargain. Do not pay. The credit (score) issue is gone since this person is deceased.

"The people on the other end of the line often have no legal obligation to assume the debt of a spouse, sibling or parent."

However, action needs to be taken with correspondence or this could possibly escalate and turn into a lawsuit.

Contact our office for your next steps.

Rental mobile home park residing mother died a year ago leaving no will and no estate. Bill collectors of credit card debts owed by mother are asking for payment via mailed through her address. Mothers assets were sold, assets such as household goods, furniture etc. Even though there is not enough funds to satisfy all debts, sibling believes an attempt to bargin with these agencies should be made. Is this a wise idea, or should they just simply be left alone?

Jojo,
Thanks for your comment. No these agencies are not offering a service. This is not a service. This is collections. Also, the account dies with the deceased.

Why all the negativity? These agencies are offering a service to help one's deceased relatives bills to be paid. Seems like win-win situation for all of us. We all leave some bills that need to be paid when we pass.

Dunno,
Thanks for your comment. We assume that you are an employee of one of these collectors. There has been much research on this for many years. We are especially friendly with WWR and P & C. They never validate the alleged debt.

Therefore, no VOD means no collections.
