Alisa,
Thanks for your comment.
14 days seem short to file an Answer and Affirmative Defenses. But true.
#1Deny
#2Forget about SOL – hard to defend in court

Use the DEFENSE GUIDE – DO IT YOURSELF
http://nextlevelunlimited.net/answer-summons.php

#3 Why bk ???

Let's talk about your other collections ASAP so you can understand you may not have to do BK.

I opened a Wal-Mart credit card some years ago (not sure if the SOL is up or not at this point) and ended up defaulting. I have received no letters from MCM until I was served a complaint filed by Midland Funding LLC ( I am assuming these are the same as MCM) with my county's civil court stating that I owe a similar amount to what I owed on the credit card. The complaint states that I must reply in writing to the court clerk within 14 days of the date the complaint was filed, either admitting or denying the allegation. My questions are these: 1. Should I admit or deny the allegation if I haven't received any previous notification of a debt owed to Midland? 2. What would be the best way to determine the actual date the SOL began running? I do not have the original signed contract or the dates on which the account became delinquent. Which does the SOL go by? 3. Will filing chapter 7 bankruptcy keep them from garnishing wages? Thanks in advance!

I just received a phone call at 8 a.m. EST from MCM and an Indian guy was on the other line. He called my cell phone (which I just changed my #) and asked for me. I told him it wasn't me. I'm so glad I had a chance to Google this company and came across this website. I know they will call back. What do I do when they call me back because I am in a lot of debt right now and I'm afraid they will get my new bank information and varnish my wages. These stories are scaring me. What should I do when they call me back? All advice is appreciated. Thank you!

I have arranged payment plans with MCM three times about dates at which they can take money out of my bank account. All three times, they have taken amounts that we did NOT agree on, on dates that we did NOT agree on either. All three times, they have coincidentally taken out enough money to bounce my bank account with, and have attempted to continue to write checks on. I have called them over and over again about this issue, and to pay my bank account with their mistake, and all I end up getting at the end of each argument is a guy from India cussing me out about being a "low-life" that doesn't know how to live in America...WTH?! I was finally able to talk with some lady from the United States about cancelling future payment plans, but they still won't put up the money to pay off their bounced check fees. What can I do? Please help!

Today I received a letter for a bill of $700.00 from a old credit card company. I called them and I verified it was a debt that i did owe and I asked them if we can work together to pay this off in payment arrangements. The man told me either I pay 300 upfront first or i will be taken to court. Hey gave me less than a month to come up with the money for the down payment and This is the first letter I have received from the mgm company. No calls, No letter until today when it basically told me pony up or get sued.
